Article 1 — Purpose

Tahiti Luggage Services SARL, hereinafter “TLS” or “the depositary”, provides a temporary luggage storage service at its premises located 13 Avenue Prince Hinoi, Papeete, under the conditions set out below.

Article 2 — Opening Hours and Rates

The service is open Monday to Friday from 8:00 am to 7:00 pm, and Saturday from 8:00 am to 12:00 pm. Current rates are as follows:

  • Small (backpack, light cabin bag): 650 XPF / 24 h
  • Standard (cabin or medium suitcase, up to 60 cm): 950 XPF / 24 h
  • Large (large checked suitcase, up to 80 cm): 1,300 XPF / 24 h
  • Oversize (surfboard, dive gear, skis, bicycle): 2,000 XPF / 24 h

Rates apply per bag and per started 24-hour period from drop-off. Any started period is payable in full. Payment is by card or cash; luggage is returned only after full payment.

Article 3 — Definition of Luggage

Luggage means any personal belongings contained in a suitcase, bag or closed container handed over at registration. The depositary has no knowledge of the contents unless expressly declared under Article 9.

Article 4 — Luggage Security

TLS maintains a permanent security system:

  • A staff member is present throughout opening hours; no drop-off or pickup occurs without them.
  • Luggage is stored in a dedicated area, separate from reception and kept locked at all times.
  • Only TLS staff may access the storage area; no client or third party is permitted.
  • The premises are under continuous video surveillance; recordings are kept for thirty (30) days then destroyed.
  • Each bag is photographed on arrival and registered under a unique number.

Article 5 — Prohibited Items

The following are strictly prohibited:

  • Cash, currency and payment instruments
  • Securities and negotiable instruments
  • Jewellery and watches
  • Precious metals and stones
  • Works of art and antiques
  • Weapons, explosives, flammable and hazardous materials
  • Medication requiring special storage
  • Original official documents
  • Perishable goods
  • Any item unlawful to hold or transport

The depositary accepts no liability for such items, even if placed inside a bag otherwise accepted for storage.

Article 6 — Security Checks

The depositary reserves the right to refuse any bag without stating reasons, to carry out visual inspections, to request the bag be opened in the client's presence, and to notify the authorities if a suspicious or prohibited item is found. Refusal to comply results in immediate refusal of the deposit.

Article 7 — Return of Luggage

Luggage is returned only upon presentation of the deposit receipt, or sufficient proof of ownership. The depositary may require supporting documents, including valid ID. Any lost receipt must be reported immediately.

The depositary is not liable for handing over luggage to any person presenting the original receipt.

Article 8 — Limitation of Liability

8.1 — Principle: liability is limited to direct material loss. No compensation is due for moral prejudice, loss of enjoyment, business interruption, indirect damages, loss of profit or any other intangible loss.

8.2 — Compensable value: in the event of loss, theft, destruction or damage attributable to the depositary, compensation is based on the actual replacement value at the date of loss, less depreciation. The client must provide a purchase invoice, proof of value, photograph or other document establishing the existence and value of the item. Without sufficient proof, no compensation is due.

8.3 — Standard cap: unless a prior value declaration is made under Article 9, liability is capped at 300,000 XPF per item and 3,000,000 XPF per collective incident. This limit applies regardless of the actual value of the contents or the number of items in the bag.

Article 9 — Value Declaration

Before drop-off, the client may declare a higher value and pay the corresponding surcharge. Liability is then raised to the declared amount, up to 1,200,000 XPF per item.

The declaration must be made before registration, expressly noted on the deposit receipt and supported by documentation. Otherwise, only the cap in Article 8.3 applies.

Article 10 — Exclusions

The depositary is not liable for:

  • Damage from an inherent defect of the bag
  • Normal wear and tear
  • Faulty closure
  • Perishable goods
  • Damage caused by the contents themselves
  • Force majeure and natural disasters
  • Terrorism, riots and strikes
  • Administrative requisitions and public authority decisions

Article 11 — Claims

Claims must be made at the time of return if the damage is visible, or within forty-eight (48) hours of return for non-visible damage. After this period, the bag is presumed returned in good condition.

The client must provide a copy of the deposit ticket, a detailed inventory, proof of value and, where applicable, photographs.

Article 12 — Uncollected Luggage

Luggage not collected within seventy-two (72) hours of the agreed pickup time may incur additional storage fees. After thirty (30) days, the bag is deemed abandoned and TLS may dispose of it in accordance with applicable regulations.

Article 13 — Limitation Period

Any action against the depositary is time-barred one (1) year from the date of return, or from the date on which return should have taken place.

Article 14 — Personal Data

Data collected — name, contact, email — is used solely for storage management and shared with no third party. Clients have the right to access, correct and delete their data. As the premises are under video surveillance, the client consents to such monitoring by depositing luggage.

Article 15 — Applicable Law

These terms are governed by the law applicable in French Polynesia. Any dispute shall be submitted, failing amicable settlement, to the competent court of Papeete.
